Privacy Policy

JH Wonderland Inc., operating as Merry Kids Playground, is responsible for the personal information we collect. This policy explains what we collect, why we collect it, who we share it with, and how you can see or correct it.

We follow Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).

1. What this policy covers

This policy covers our website, our booking and waiver system, and your visit to the playground.

We use a third party called LilYPad to run bookings, tickets and waivers, and a payment processor called Sola to handle card payments. Your information is held in their systems, but we're responsible for how we handle it. If you have a question about your information, please contact us rather than LilYPad or Sola.

2. What we collect

When you use this website

If you send us a message, we collect your name, email address, the kind of enquiry, your message, and your phone number if you choose to give it. If you tick the box asking us to keep you posted, we also add your email to our news list.

We don't currently use analytics, advertising trackers or social media pixels on this site. If that changes, we'll update this policy.

When you book or sign a waiver

Bookings, tickets and waivers are handled by LilYPad. Depending on what you're doing, this includes the adult's name, email, phone number and address, the names and dates of birth of children in your group, emergency contact details, your signature on the waiver, and a record of your bookings and visits.

The waiver also asks whether you agree to photos of your child being taken and how they may be used. Your answer is recorded with your waiver.

When you pay

Card payments are processed by Sola. Your card details go directly to Sola and we never see or store your card number. We keep a record of the transaction, such as the amount, the date and what you bought.

When you visit us

We use video cameras at the entrance and in the play areas for safety and security. There are no cameras in washrooms or change areas. Footage is kept for 30 days and then automatically overwritten, unless we need to keep a specific clip because of an injury, an incident or a claim.

Photos and video we take

We don't publish photos that identify children from regular play sessions. Photos used on our website and social media come from arranged photo sessions where families have signed a separate consent form, or they're shot so that no one can be identified.

If a party package includes photos, those go to the family who booked. We don't publish them unless that family agrees in writing.

You can change your mind at any time. Contact us using the details in section 13 and we'll remove the photo from our website and our own social accounts. We can't always control copies that other people have already saved or shared.

3. Why we use your information

• To take and manage your booking, and to admit you to the playground
• To run the waiver we need before anyone plays
• To answer your questions
• For safety and security, including responding to injuries, incidents and claims
• To meet legal, insurance and accounting requirements
• To keep our website working properly
• To send you news about Merry Kids, but only if you asked for it

We don't sell your information. We don't use it for advertising.

4. Your consent

By booking, signing a waiver or sending us a message, you agree to us handling your information as described here.

News emails are separate. We only send them if you tick the box, and you can unsubscribe from any email using the link at the bottom. Unsubscribing doesn't affect your bookings.

5. Children's information

We collect children's information from a parent or guardian, not from the child. Our website isn't designed for children to use on their own, and we don't knowingly collect information from a child through it.

6. Who we share information with

• LilYPad POS (Ontario, Canada), for bookings, tickets and waivers
• Sola Payments (United States), for card payments
• Webflow (United States), which hosts this website
• Mailchimp (United States), if you're on our news list
• Our insurer and our lawyers, if there's a claim or a legal issue
• Police or other authorities, if the law requires it or in an emergency

We only give these companies the information they need to provide their services for us.

7. Where your information is kept

Website and booking information is stored in Canada and the United States.

Payment information is processed in the United States by Sola, and website hosting also takes place in the United States. When information is stored outside Canada, it's subject to the laws of that country, and courts or authorities there may be able to access it.

8. How long we keep it

• Messages you send us: 2 years from your last contact
• Bookings and visit records: 7 years
• Waivers: until the child turns 18, plus 2 years
• Video footage: 30 days
• News list: until you unsubscribe

9. Keeping it safe

Information in LilYPad is protected by that system's security controls, including encrypted connections. Card details are handled by Sola and never stored on our systems. Video footage and any printed records are kept where only authorized staff can access them.

No system is perfect, but we take this seriously and limit access to people who need it.

10. Seeing or correcting your information

You can ask us what information we hold about you, ask us to correct it, or ask us to delete it. Contact us using the details in section 13 and we'll reply within 30 days.

Some information we have to keep, such as waivers and accounting records, even if you ask us to delete it. If that's the case, we'll tell you why.

If you're not happy with our answer, you can contact the Office of the Privacy Commissioner of Canada at priv.gc.ca.

11. Other websites

Our site links to LilYPad for booking and waivers. Once you're there, LilYPad's privacy policy applies. We also link to JH Supermarket and our social media accounts, which have their own policies.

12. Changes to this policy

If we change this policy, we'll post the new version here and update the date at the top.
